After a quick perusal of Teh Konstitution [do they really print that on the back of a Captian Bullshit Crunch box?] Atty. General Eric Holder remarked that the “apt” comparison for Osama bin Laden is to mass murderers like Charles Manson who, despite being murderers, still reserve the right to go before a jury and have the charges against them proved beyond a reasonable doubt.  Culbertson failed to ask him which clause of the actual Constitution he found that foreign nationals and enemy combatants are to be treated as though they had US Citizenship.
