"We The ...” who, now?
Reporting from Sacramento—Forty-three Democratic legislators, including leaders of the California Senate and Assembly, filed a brief Monday urging the California Supreme Court to void Proposition 8.
In their brief, lawmakers described the 500,000-vote margin as a “bare majority,” and said it was “compromising the enduring constitutional promise of equal protection under the law.”...
“If Proposition 8 takes effect, this court will no longer be the final arbiter of the rights of minorities,"
"Furthermore, treating Proposition 8 as a mere amendment would divest the Legislature of its constitutional authority to subject such a fundamental abrogation of the equal protection clause to its deliberative processes."
So what this is really about is a massive power struggle between The People and our employees?
Maybe we, The People, don’t have the authority to even elect those employees. Perhaps, next time, we ought to see what happens if there are no ballots cast. None. Zip. Zero. Would they simply declare themselves elected for life?
And, I am sure, we can count on the courts and the legislature to protect the rights of that minority ??? of people who disagree with gay marriage to speak out publicly, hm?
