A Question of Methodology

or:  The Method is the Message

Domains are being seized by the U.S. Department of Justice and Department of Homeland Security under the auspices of ICE. Not only are they being seized but it is happening without any notification but also apparently with the assistance of ICANN.

...ICANN totally bypassed GoDaddy and assisted the U.S. Government in the seizure of [Torrent-Finder].

...Google can produce the same results that Torrent-Finder, or any torrent search engine out there ...[If] Google can perform exactly the same types of searches and probably return even better results why are the sites doing the same thing being seized?

Obligatory Statement:  Stealing is Bad.

Another Obligatory Statement:  Unequal application of The Law is Very Bad

Now, some Obligatory Questions:
What about the idea of a Cease and Desist Letter?
What do the functions of Homeland Security and ICE have to do with torrents of pirated material?
Isn’t this a tad heavy-handed considering the subject matter in question?

  1. “What do the functions of Homeland Security and ICE have to do with torrents of pirated material?”

Perhaps an indirect bribe to get sympathetic treatment from the entertainment industry.

At least we are not yet as far down the road as the UK, where an auto-repair-shop owner was fined for “public performance” of copyrighted material because he set the volume of his radio high enough that his mechanics could hear it.

  2. John:  Not too long ago, somewhere over here, a few years back, a barber shop was hit with a big suit because they [gasp] had a radio tuned to a music station.

Back to that UK story: would it have been OK if all the mechanics had Walkman radios?

Unfortunately, Formerly Great Britain is being run by Stark Raving Madmen.

We seem to be doing our best to elect our own SRM types - at least, up till the last election.

But we here in California are trying to make up for that deficit. We’ve elected Democrats all the way up and down the line.
